The Uk constitution came first, or at least the system of government did, so clearly it affected the US more, we may see the US affect ours more in years to come as their’s is more fluid and flexible than ours but for the moment, in terms of affecting the system, our systems affected theirs through turning them away from traditional European styles of rule.
What is the impact of Constitutional Reform Act 2005 and how far is the US an influence on this?
The reform act gives us a supreme court in place of our traditional House of Lords and so it is obviously influenced by the US system as they also have a supreme court. However, the HOL is still effectivley the highest court in the land, it’s just more specialised. The US system as a later system, borne to erase the errors of European systems shows us flaws in our systems, yet our systems were instrumental in creating theirs.
It also restricts the judiciary’s freedom from the legislature and executive, therein binding them closer anf using the powers together, to strengthen the centralised government. Not necessarily a bad thing mind..
That’s another way we affected the US, their powers are vastly more independent than ours and this is most likely a result of attempting to be different to our systems.
